This Privacy Policy explains how Matthew Chmil, an individual doing business as Chmil Coaching (“Chmil Coaching,” “we,” “us” or “our”), collects, uses, discloses, stores and otherwise processes personal information.

This policy applies when you visit chmilcoaching.com, purchase a product or coaching membership, complete onboarding or health-screening materials, use our coaching application or web portal, communicate with us, participate in coaching or otherwise interact with Chmil Coaching (collectively, the “Services”).

Chmil Coaching’s online store is powered by Shopify. Coaching services are primarily administered through ABC Trainerize and may also involve other service providers described below.

Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have reviewed this policy. Where applicable law requires consent for particular processing, we will request that consent separately.

PERSONAL INFORMATION WE COLLECT

The information we collect depends on how you interact with Chmil Coaching and may include the following categories.

Contact and Identification Information

This may include:

  • your name;

  • billing and shipping addresses;

  • email address;

  • telephone number;

  • city, state or province, country and time zone;

  • age or date of birth;

  • emergency-contact information; and

  • other identifying or contact information you provide.

Account and Transaction Information

This may include:

  • Shopify and coaching-platform account information;

  • order numbers and purchase history;

  • membership plan, price, discounts and billing status;

  • subscription renewals, cancellations, returns and refunds;

  • shipping information;

  • promotional-apparel eligibility;

  • customer-service records; and

  • payment confirmation and transaction information.

Payment-card information is generally processed by Shopify and its payment providers. Chmil Coaching does not ordinarily receive or store your complete payment-card number.

Coaching, Fitness and Health-Related Information

To provide individualized fitness and general-wellness nutrition coaching, we may collect information such as:

  • height, weight, body measurements and body-composition information;

  • fitness, performance, body-composition and lifestyle goals;

  • exercise experience and training history;

  • workout performance, strength, cardio activity and program adherence;

  • injuries, pain, symptoms, physical limitations and activity restrictions;

  • health history, medical conditions, procedures, pregnancy status and medications;

  • physician or licensed health-care-provider restrictions or clearance;

  • PAR-Q+ and other health-screening responses;

  • nutrition habits, food logs, calorie or macronutrient information;

  • allergies, intolerances, dietary restrictions and food preferences;

  • sleep, stress, energy, recovery and hydration information;

  • steps, heart rate, blood pressure and other activity or wellness information;

  • progress photographs and videos;

  • exercise-form videos;

  • consultation and check-in responses;

  • coaching notes and plan-adjustment records; and

  • other information you voluntarily provide that is relevant to safe and effective coaching.

Some of this information may be considered sensitive personal information, consumer health information or special-category data under applicable law.

Connected Applications and Devices

If you choose to connect a compatible application, wearable or health platform to Trainerize, information authorized by you may be transmitted from that service to Trainerize and made available to Chmil Coaching.

Depending on the connection and permissions you select, this may include information from Apple Health, Google Health Connect, Fitbit, Garmin, Withings, MyFitnessPal or another compatible service, such as:

  • steps and physical activity;

  • workouts and cardio activities;

  • body weight or body-composition information;

  • sleep;

  • calories burned;

  • heart rate;

  • blood pressure; and

  • other authorized health or activity metrics.

Connecting these services is optional. You control the permissions granted through the applicable device, application or platform and may disconnect them through the available settings.

Communications and Client Content

We may collect:

  • emails and support inquiries;

  • Trainerize messages;

  • questionnaire and form responses;

  • consultation and coaching-call notes;

  • weekly check-ins;

  • photographs, videos and other files you submit;

  • feedback, reviews or testimonials; and

  • other communications with Chmil Coaching.

Chmil Coaching will not record a coaching call, consultation or video call without the advance consent of every participant.

Progress photographs, exercise videos and other content submitted for coaching may be used internally to provide the Services. We will not use your name, likeness, testimonial, before-and-after image or identifiable progress content in public marketing without a separate, optional written media release.

Website, Device and Usage Information

When you visit our website or use online Services, we or our providers may automatically collect:

  • IP address;

  • device and browser information;

  • operating system;

  • network and approximate location information;

  • cookie and similar-technology identifiers;

  • pages viewed and website interactions;

  • referring links;

  • dates and times of access; and

  • security, diagnostic and performance information.

INFORMATION SOURCES

We may collect personal information:

  • directly from you;

  • automatically through our website and online Services;

  • through Shopify and payment providers;

  • through Trainerize;

  • from applications or devices you voluntarily connect;

  • from electronic-signature, communication and scheduling providers;

  • from a person you authorize to provide information;

  • from a third-party payer, spouse or bundled participant, limited to information reasonably necessary to administer the payment or bundle;

  • from service providers acting on our behalf; and

  • where permitted by law, from other partners or third parties.

HOW WE USE PERSONAL INFORMATION

We may use personal information to:

  • process purchases and recurring payments;

  • administer subscriptions, cancellations, refunds and returns;

  • create and manage customer and coaching accounts;

  • conduct onboarding and health-and-safety reviews;

  • determine whether requested coaching is within our qualifications, lawful scope and insurance coverage;

  • request clarification or medical clearance when appropriate;

  • prepare and adjust individualized training programs;

  • provide general-wellness nutrition coaching;

  • review workouts, check-ins, progress, nutrition logs and exercise videos;

  • communicate with you and provide customer support;

  • schedule consultations and coaching calls;

  • track program participation and progress;

  • ship physical products or promotional apparel;

  • maintain coaching, safety, business, legal and transaction records;

  • protect clients, Chmil Coaching and our service providers from fraud, misuse, security threats and illegal activity;

  • enforce our agreements and policies;

  • comply with legal, tax, insurance and regulatory obligations;

  • establish, exercise or defend legal claims;

  • improve our Services and business operations;

  • measure website performance;

  • provide marketing where permitted; and

  • perform other purposes disclosed when information is collected or authorized by you.

USE OF COACHING AND HEALTH-RELATED INFORMATION

We use coaching and health-related information to provide, personalize, document and safely administer the coaching relationship.

Chmil Coaching does not sell client health information. We do not use health-screening responses, medical information, progress photographs, exercise videos, private coaching messages or nutrition logs for targeted advertising.

We may limit, pause, modify or decline Services when information indicates that participation may be unsafe, requires medical clearance, falls outside our qualifications or lawful scope, or cannot reasonably be supported.

Chmil Coaching does not use coaching information to diagnose or treat disease or provide medical nutrition therapy.

HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information only as reasonably necessary for the purposes described in this policy, including to the following recipients.

Shopify and Payment Providers

Shopify hosts our store and processes ecommerce, customer-account, subscription, payment and transaction information.

ABC Trainerize

Trainerize provides the coaching application and web portal used for programming, messaging, progress tracking, nutrition tracking, scheduling and related coaching functions.

ABC Fitness Solutions generally processes client information within Trainerize on behalf of Chmil Coaching. Review its privacy information at:

Technology and Business Providers

We may use service providers for:

  • cloud storage;

  • business email and document management, including Google Workspace or Google Drive;

  • electronic signatures;

  • scheduling, telephone or video calls;

  • website hosting and analytics;

  • payment processing;

  • fraud prevention and security;

  • shipping and order fulfillment;

  • bookkeeping, accounting and tax preparation;

  • insurance and risk management; and

  • technical or customer support.

These providers may process information only as permitted by their agreements, privacy policies and applicable law.

Connected Applications and Devices

When you direct Trainerize to connect with an application, wearable or health platform, information may be exchanged with that provider according to the permissions you select and that provider’s privacy policy.

Professional Advisers and Authorities

We may disclose information to attorneys, accountants, insurers, regulators, courts, law enforcement or other appropriate parties when reasonably necessary to:

  • comply with law or valid legal process;

  • address a credible safety concern;

  • protect a person from a credible risk of harm;

  • investigate fraud, misuse or illegal conduct;

  • enforce agreements;

  • collect payment; or

  • establish, exercise or defend legal claims.

Business Transactions

Information may be transferred as part of a merger, financing, reorganization, sale of assets, formation of a successor business, bankruptcy or similar transaction, subject to applicable law.

At Your Direction

We may disclose information when you request, direct or expressly authorize us to do so.

COUPLES, HOUSEHOLDS AND THIRD-PARTY PAYERS

Each coaching participant has a separate and private coaching relationship.

Marriage, partnership, family status, a shared payment method or participation in a bundled offer does not authorize Chmil Coaching to disclose one participant’s health, nutrition, progress, photographs, messages or other private coaching information to another participant or payer.

Information may be shared only when necessary to administer the payment or bundle, when the affected client expressly authorizes specific disclosure, or when another disclosure described in this policy is permitted.

A client may withdraw a communication authorization prospectively by contacting us.

MARKETING, ADVERTISING AND SHOPIFY ENHANCED SERVICES

We may use contact and transaction information to send marketing or promotional communications where permitted. You may unsubscribe from promotional emails using the link in the message.

Unsubscribing from marketing does not prevent necessary communications about purchases, subscriptions, coaching, safety, account administration or policy changes.

Shopify may process website and commerce activity through enhanced services that use information from interactions with our store, other merchants and Shopify. Depending on where you live, this activity may be considered targeted advertising, sharing or a sale under applicable law.

COOKIES AND SIMILAR TECHNOLOGIES

Our website and providers may use cookies and similar technologies for:

  • necessary website and checkout functions;

  • account authentication;

  • security and fraud prevention;

  • preferences and functionality;

  • analytics and performance; and

  • marketing and advertising where permitted.

You may manage available choices through our cookie banner, browser settings and data-sharing opt-out page. Blocking necessary cookies may prevent some website, account or checkout features from functioning.

LEGAL BASES FOR PROCESSING

Where applicable law requires a legal basis, we may process personal information:

  • to perform or prepare to perform a contract with you;

  • with your consent;

  • to comply with legal obligations;

  • to protect vital interests;

  • for legitimate interests that are not overridden by your rights, such as providing, securing, improving and documenting the Services; or

  • to establish, exercise or defend legal claims.

Where required for sensitive or health-related information, we will rely on an appropriate legal basis, which may include your explicit consent. Withdrawal of consent does not affect processing that occurred lawfully before withdrawal and may make it impossible to continue individualized online coaching.

SECURITY

We use reasonable administrative, technical and organizational safeguards appropriate to a small remote-coaching business and the nature of the information processed.

These safeguards may include controlled account access, passwords, multifactor authentication where available, reputable service providers, access limitations and secure storage practices.

No internet, email, cloud, mobile or electronic system can be guaranteed completely secure. Please use Trainerize or another designated secure method instead of ordinary email when submitting sensitive health information whenever reasonably possible.

If a security incident occurs, we will investigate and provide notifications to affected individuals, regulators or others when required by applicable law.

RETENTION

We retain personal information for as long as reasonably necessary to:

  • provide and document the Services;

  • maintain accounts and transaction records;

  • satisfy legal, tax, insurance and contractual requirements;

  • respond to safety issues;

  • resolve disputes;

  • enforce agreements; and

  • establish, exercise or defend legal claims.

Retention periods vary by the type of information, the service provider involved and the reason for collection.

After an account is deactivated or coaching ends, some historical information may remain within Trainerize, Shopify, backups or other service-provider systems according to their retention practices and our lawful recordkeeping needs.

When information is no longer reasonably necessary, we may delete or de-identify it, subject to technical limitations and lawful retention requirements.

THIRD-PARTY WEBSITES AND SERVICES

Our Services may link to or integrate with websites, applications and platforms operated by third parties. Their privacy practices, security and terms apply to information they independently collect or control.

Review the privacy settings and policies of any connected application, wearable, social network or other third-party service before using it.

INTERNATIONAL TRANSFERS

Personal information may be transferred to, stored or processed in countries other than the country where you live, including the United States and locations where our service providers operate.

Where applicable law requires a transfer mechanism or additional safeguards, we or the applicable provider will use a legally recognized mechanism or other lawful basis for the transfer.

CHILDREN’S PRIVACY

Chmil Coaching does not accept coaching clients under eighteen years old through this program, and the Services are not directed toward children.

We do not knowingly collect personal information from a child in violation of applicable law. A parent or legal guardian who believes a child provided personal information may contact us to request appropriate action.

YOUR PRIVACY RIGHTS

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • request access to personal information we maintain;

  • request correction of inaccurate information;

  • request deletion;

  • receive a portable copy of certain information;

  • restrict or object to certain processing;

  • withdraw consent where processing relies on consent;

  • opt out of targeted advertising, sale or sharing as defined by applicable law;

  • limit certain uses of sensitive personal information;

  • appeal a decision concerning a privacy request; and

  • lodge a complaint with an appropriate regulator.

These rights are not absolute. We may retain or continue processing information when permitted or required for contracts, payments, taxes, insurance, safety, legal claims, regulatory duties or other lawful reasons.

Where permitted, an authorized agent may submit a request for you. We may require proof of authorization and direct identity verification.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

EEA AND UNITED KINGDOM RIGHTS

If you reside in the European Economic Area or United Kingdom, you may also have the right to:

  • object to certain processing;

  • request restriction of processing;

  • withdraw consent;

  • lodge a complaint with your local supervisory authority; and

  • receive information concerning applicable international-transfer safeguards.

PRIVACY REQUESTS AND DELETION

Privacy requests may be submitted to support@chmilcoaching.com.

Deleting a Shopify or coaching account does not necessarily require deletion of every record. Chmil Coaching may retain signed agreements, waivers, payment records, safety records, communications or other information when reasonably required by law, insurance, contract, dispute or legitimate recordkeeping needs.

If deletion of information necessary for safe and individualized coaching is requested, Chmil Coaching may be unable to continue providing the Services.

CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy to reflect changes in our Services, providers, technology, legal obligations or business practices.

We will post the revised policy, update the “Last updated” date and provide additional notice when required by applicable law.
